I. INTRODUCTION

This Shiptotal Cargo Insurance Facilitation Policy ("Policy") governs the process and terms by which Shivansh Shiptotal Technologies Private Limited ("Shiptotal") facilitates cargo insurance for shipments booked through its website. Shiptotal acts as an intermediary, connecting users with established freight providers that offer cargo insurance services.

User is defined as the person who avails any of the services of Shiptotal as mentioned on its website exclusively for the purposes of cargo and courier aggregation services.

II. INSURANCE FACILITATION PROCESS

• 1. User Notification:
• a. Users intending to secure cargo insurance for their shipments must notify Shiptotal exclusively during the booking process. Any information for availing insurance after the booking of the courier will not be entertained by Shiptotal.
• b. Notification should include specific insurance requirements, if any and payment for these additional services shall be made in advance during the booking process in failure to which Shiptotal reserves the right to cancel the insurance procurement.

2. Communication with Freight Providers:

• a. Upon user notification, Shiptotal will initiate communication with relevant freight providers to secure insurance on behalf of the user as per the specific requirements of the User.
• b. Shiptotal will convey user-specific insurance needs to the freight provider as is communicated by the User.
• c. Shiptotal bears no responsibility if the freight provider refuses to provide insurance under any circumstances. This shall be adequately communicated to the User and it shall be at the option of the User to continue without insurance or choose a different freight provider under such circumstances.

3. Terms and Conditions:

Shiptotal will inform the user of the secured insurance, providing a detailed breakdown of terms and conditions as outlined by the respective freight provider.

III. SHIPTOTAL'S ROLE

• 1.Mediator:
• a. Shiptotal functions solely as a mediator between users and freight providers in facilitating the acquisition of cargo insurance and has no involvement as to provide insurance on its own behalf to the users of the cargo and shipping aggregator services.
• b. Shiptotal does not engage in the direct provision of insurance and bears no liability for such services.

2. No Direct Insurance Provision:

Shiptotal does not directly provide cargo insurance services; instead, it facilitates the connection between users and established freight providers for obtaining such insurance services.

3. No Responsibility for Goods or Insurance:

• a. Shiptotal bears no responsibility for any damage or loss of goods during transit.
• b. Shiptotal is not liable for the terms and conditions of insurance provided by the freight provider and cannot be dragged as a party to any Legal dispute of the User with the freight provider.

IV. USER RESPONSIBILITIES

1. Informed Decision:

• a. Users are responsible for notifying Shiptotal of their insurance requirements during the booking process.
• b. Users must make informed decisions regarding the coverage offered by the freight provider after thoroughly reading and understanding all the terms and conditions as is elaborately detailed by the freight aggregators who provide insurance as Shiptotal has no role in defining such terms and conditions nor bears the responsibility as a Party to any contract entered into between User and freight provider.
• c. Owner’s Risk Option:During the booking process, the Customer will be presented with the option to select "Owner’s Risk." Under this option, the owner of the goods shall bear the entire risk of loss or damage during transit. In the event of loss or damage to the goods while in transit, the owner shall assume full responsibility and bear all associated costs. As the Customer has declined to purchase insurance. Shiptotal shall only provide certificate of the fact (COF) in the event of loss during transit.
• d. Carrier’s Risk Option:Alternatively, the Customer may opt for "Carrier’s Risk" at the time of booking. Under this option, Shiptotal assumes the risk of loss or damage to the goods during transit. Should the goods be lost or damaged while in transit, Shiptotal shall be held liable and may be required to compensate the owner accordingly. Although an additional charge for insurance applies under this option, in that case required to inform to shiptotal within 24hours of delivery of goods with required documents for process of the claim with selected shipping partner, after all survey and verifications claim will be processed if facts are found true with deduction of relevant processing charges.

Understanding Terms:

• a. Users must thoroughly understand the terms and conditions of the insurance provided by the freight provider.
• b. Agreement to the terms is a prerequisite for insurance facilitation and Shiptotal bears no responsibility in case of any ambiguity in the terms of the agreement as provided by the freight aggregators providing insurance.

V. COMMUNICATION AND NOTIFICATIONS

1. Prompt Communication:

• a. Shiptotal will promptly communicate with users regarding the insurance secured, providing comprehensive details and terms as is requested by the User.
• b. Users will be kept informed throughout the insurance facilitation process.

2. Accident Notification:

• a. In case of any accident, the User will immediately intimate Shiptotal within 24 hours.
• b. Shiptotal will further notify the shipping partner within the next 24 hours.

3. Notification of Changes:

• a. Users will be notified promptly of any changes to the insurance coverage or terms communicated by the freight provider as and when the same is communicated to Shiptotal by the freight provider.
• b. User is advised to stay updated with any modifications or changes to the insurance policy as and when any guideline, circular, notification or Regulation is provided by the freight aggregator.
• c. Shiptotal bears no responsibility if the terms and conditions are changed by the freight aggregator as Shiptotal only serves as a median of obtaining these services on behalf of the user.

VI. DISPUTE RESOLUTION

1. Disputes arising from or related to cargo insurance facilitated by Shiptotal shall be resolved as per the terms outlined in Shiptotal's overarching Terms of Use.

2. The exclusive jurisdiction to any matter including legal or remedial action will be the Courts of New Delhi.

VII. MODIFICATIONS AND UPDATES

1. Shiptotal reserves the right to modify or update this Cargo Insurance Facilitation Policy as and when necessary and the User is advised to stay updated with the latest Cargo Insurance facilitation policy to avoid any inconveniences.

2. Users will be duly notified of any changes over registered contact details be it email or mobile number at the sole discretion of Shiptotal, and the updated policy will become effective from the specified date as mentioned on the policy.

3. Shiptotal bears no responsibility in case the notification about updated Cargo insurance facilitation is not delivered to the user in view of any technical glitch, snag or difficulty or any unforeseen circumstances which would impair the ability of Shiptotal to issue the updated guidelines.
